These Terms & Conditions apply to photography services, products and bookings provided by Wight Shutter Photography.
By making a booking, purchasing a product or otherwise engaging Wight Shutter Photography to provide photography services, you agree to these Terms & Conditions.
1. About Wight Shutter Photography
Wight Shutter Photography is a sole trader photography business based on the Isle of Wight, United Kingdom.

In these Terms & Conditions:
- “I”, “me” and “my” refer to Wight Shutter Photography.
- “You” and “your” refer to the client or customer.
- “Services” means photography services provided by Wight Shutter Photography.
- “Images” means photographs created by Wight Shutter Photography.
- “Products” means photographs, prints, albums, artwork or other products purchased from Wight Shutter Photography.
2. Bookings
A booking is considered confirmed once:
- The requested date and service have been agreed;
- You have accepted the applicable quotation or booking details; and
- Any required booking fee or deposit has been paid.
Until these requirements have been met, a date may remain available for other clients to book.
For weddings, events and other photography assignments, the booking details, agreed package and price will be confirmed with you before the booking is finalised.
3. Booking fees and deposits
A booking fee or deposit may be required to secure your date.
Unless otherwise agreed in writing, the booking fee/deposit is non-refundable if you cancel your booking, except where you have a legal right to a refund or where Wight Shutter Photography agrees otherwise.
The booking fee is taken into account when calculating the total cost of the agreed service where applicable.
The remaining balance must be paid by the date stated on your invoice or booking confirmation.
4. Prices and quotations
Prices will be confirmed at the time of booking.
Quotes are normally valid for the period stated on the quotation. If no expiry date is stated, the quotation may be withdrawn or amended before the booking is confirmed.
Additional services, products, travel, editing or other expenses may incur additional charges where agreed with you.
Any additional charges will be communicated to you before they are incurred wherever reasonably possible.
5. Payment
Payment can be made using the payment methods made available by Wight Shutter Photography.
Where online payment is available, payment may be processed through a third-party payment provider.
You are responsible for providing accurate payment and contact information.
Wight Shutter Photography reserves the right to suspend or decline services where an agreed payment has not been received.
6. Cancellation by the client
If you need to cancel your booking, please contact Wight Shutter Photography as soon as possible.
Cancellation charges may apply depending on the type of booking, how much notice is provided and any costs or commitments already incurred.
Any booking fee or deposit will normally be retained where you cancel, except where you have a legal right to a refund.
For larger bookings such as weddings and events, cancellation terms and payment deadlines may be set out separately in your booking agreement.
Nothing in these Terms & Conditions removes or limits any statutory cancellation or consumer rights that apply to your booking.
7. Rescheduling
I will do my best to accommodate requests to change a booking date.
Rescheduling is subject to availability.
Where a booking is moved to a new date, the original booking fee may normally be transferred to the new date where reasonably possible.
If the new date is unavailable, the booking may be treated as a cancellation.
Additional costs may apply where rescheduling results in additional expenses or where third-party services have already been arranged.
8. Cancellation or postponement by Wight Shutter Photography
I will make every reasonable effort to provide the agreed photography service.
However, in exceptional circumstances, I may need to cancel or postpone a booking due to circumstances beyond my reasonable control, including serious illness, accident, equipment failure, extreme weather, travel disruption, venue closure or other circumstances that make it impossible or unsafe to provide the service.
Where possible, I will offer an alternative date or, where appropriate, help you find a suitable replacement photographer.
If I am unable to provide the service and no suitable alternative can be agreed, any payment you are legally entitled to have refunded will be refunded.
9. Force majeure
I will not be responsible for failure or delay in providing services where this results from circumstances beyond my reasonable control.
Such circumstances may include:
- Severe weather
- Natural disasters
- Fire
- Flood
- Power or internet failure
- Serious illness or injury
- Government restrictions
- Venue closure
- Transport disruption
- Civil emergency
- Equipment failure despite reasonable maintenance
- Other events outside my reasonable control
I will take reasonable steps to minimise the impact of such circumstances and will communicate with you as soon as reasonably possible.
10. Photography style
You acknowledge that photography involves an element of artistic judgement and style.
By booking Wight Shutter Photography, you acknowledge that the final images will reflect my photographic and editing style.
I will make reasonable efforts to take photographs consistent with the agreed service and any reasonable requests discussed before the booking.
However, I cannot guarantee that every requested photograph, pose, person, moment or specific image will be captured.
For weddings and events in particular, the timing and availability of subjects, lighting, weather, venue restrictions and other circumstances may affect the photographs obtained.
11. Client responsibilities
You are responsible for providing accurate information about your booking.
You should inform me in advance of any important requirements, restrictions, accessibility needs or other circumstances that may reasonably affect the photography service.
For weddings and events, you are responsible for providing accurate information about:
- Venue locations
- Timings
- Key people
- Important photographs or group combinations
- Access arrangements
- Any venue photography restrictions
I will make reasonable efforts to accommodate requests provided in advance.
12. Guests and participants
You are responsible for ensuring that guests and participants behave appropriately during the photography service.
I reserve the right to stop or withdraw from a photography service where a person’s behaviour creates an unsafe or abusive environment.
This includes serious threatening, aggressive, discriminatory or abusive behaviour towards me or others.
Where a photography service is stopped for these reasons, the booking may still be treated as fulfilled to the extent permitted by law.
13. Delivery of photographs
The expected delivery time for photographs will depend on the type of service booked.
I will provide an estimated delivery timeframe where reasonably possible.
Editing and post-production are an important part of the service and delivery times may vary depending on workload, the size of the booking and the level of editing required.
For wedding and larger event photography, delivery times may be longer.
I will make reasonable efforts to keep you informed of any significant delay.
14. Digital photographs
Where digital photographs are included, they will normally be supplied using an online gallery, download link or other digital delivery method.
You are responsible for downloading and safely storing your photographs once they have been delivered.
Although I may retain backup copies for a period of time, I cannot guarantee permanent storage of your images.
You should make your own backup copies of important photographs.
15. Prints and physical products
Where you purchase prints, albums or other physical products, production times will vary depending on the product and supplier.
Colours and appearance may vary slightly between your screen and the final printed product.
Minor variations in colour, cropping, paper, materials or finish do not necessarily constitute a defect.
Where a product arrives damaged or defective, please contact me as soon as reasonably possible with details and photographs of the issue.
16. Shipping and delivery
Where physical products are shipped, you are responsible for providing an accurate delivery address.
Wight Shutter Photography cannot be responsible for delays caused by incorrect delivery information supplied by you or by the delivery provider.
If an item is returned because an incorrect address was provided, additional delivery charges may apply.
Any applicable statutory consumer rights relating to faulty, damaged or incorrectly supplied goods remain unaffected.
17. Copyright
Unless otherwise agreed in writing, copyright in all photographs created by Wight Shutter Photography remains with Wight Shutter Photography.
Purchasing photographs or receiving digital image files does not transfer copyright ownership to the client.
You receive a personal licence to use the photographs for private, non-commercial purposes, unless a different licence has been agreed in writing.
18. Personal use of photographs
Unless otherwise agreed, you may:
- Download and store your photographs
- Print your photographs for personal use
- Share your photographs with friends and family
- Display your photographs on personal social media accounts
You must not sell, license, commercially exploit or materially alter the photographs without prior written permission.
Where sharing photographs online, crediting Wight Shutter Photography is appreciated but is not normally required unless agreed as part of your booking.
19. Commercial use
If you wish to use photographs commercially, including for advertising, business websites, product promotion, publications or other commercial purposes, you must obtain permission from Wight Shutter Photography unless commercial usage rights have already been included in your agreement.
Additional fees may apply.
20. Editing and alterations
The final photographs will be edited according to my normal style unless specific editing requirements have been agreed beforehand.
I do not normally provide unedited RAW files.
Requests for substantial additional editing or alterations outside the agreed service may incur an additional charge.
21. Promotional use by Wight Shutter Photography
Wight Shutter Photography may wish to use photographs in portfolios, on its website, social media or other promotional materials.
Where your consent is required, this will be requested separately from these Terms & Conditions.
You are not required to agree to promotional use in order to book photography services.
22. Image storage and backups
I take reasonable steps to store and protect client photographs.
However, electronic storage systems can fail and no backup system can guarantee permanent preservation.
I recommend that clients download and back up their photographs as soon as they receive them.
Wight Shutter Photography cannot guarantee that photographs will be available indefinitely after delivery.
23. Equipment failure
I use professional photography equipment and take reasonable steps to maintain and check my equipment.
However, equipment can occasionally fail.
Where equipment failure occurs, I will make reasonable efforts to continue providing the service using backup equipment or other appropriate measures where available.
I will not be liable for circumstances beyond my reasonable control.
24. Liability
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
I will provide services with reasonable care and skill.
To the extent permitted by law, I will not be responsible for losses that are unforeseeable, indirect or outside the reasonable scope of the service.
Nothing in these Terms & Conditions affects your statutory consumer rights.
25. Personal possessions
Clients and guests remain responsible for their personal belongings during photography sessions and events.
Wight Shutter Photography cannot accept responsibility for loss or damage to personal possessions except where caused by negligence or where liability cannot legally be excluded.
26. Privacy and personal information
Personal information will be handled in accordance with the Wight Shutter Photography Privacy Policy.
The Privacy Policy explains how personal information, booking information and photographs are collected, used, stored and protected.
27. Complaints
If you have a complaint about a service or product, please contact me as soon as possible at:

I will make reasonable efforts to understand and resolve the issue.
Please provide as much information as possible about the problem, including your booking or order details where relevant.
28. Changes to these Terms & Conditions
I may update these Terms & Conditions from time to time.
The Terms & Conditions that apply to your booking will normally be the version in effect when your booking is confirmed, unless a later change is required by law or otherwise agreed with you.
29. Governing law
These Terms & Conditions are governed by the laws of England and Wales.
Any dispute will be subject to the applicable courts of England and Wales, subject to any mandatory consumer rights that may apply.
30. Your statutory rights
Nothing in these Terms & Conditions is intended to remove, restrict or replace rights that you have under UK consumer protection or other applicable law.
Where these Terms & Conditions conflict with a mandatory legal right, the applicable legal right will take precedence.
